A federal judge has ruled that evidence obtained during a recent sweep of the hip-hop music mogul's jail cell cannot be used at his upcoming bail hearing.

AceShowbiz - Sean "P. Diddy" Combs appeared in court on Tuesday, November 19, for a hearing regarding evidence obtained during a sweep of his jail cell. Judge Arun Subramanian ruled that the evidence, consisting of 19 pages of notes, cannot be considered at his bail hearing. The prosecution has been ordered to destroy its copies of the notes.
Combs' attorneys had argued that the seizure violated attorney-client privilege as the notes included trial strategies and discussions with his lawyers. Assistant U.S. Attorney Christy Slavik, however, maintained that most of the seized items were not legally privileged and were unrelated to the case. Slavik stated that the notes were mostly personal, including birthdays and inspirational quotes.
The judge granted Combs' request to appear in court unshackled to avoid potential juror bias. Combs has been charged with trafficking, racketeering, and transportation related to organizing forced performances involving women. He has been incarcerated at the Metropolitan Detention Center in Brooklyn since his September arrest. His bail hearing has been scheduled for Friday, November 22.
Defense attorney Marc Agnifilo argued that the seizure of the notes has been "outrageous government conduct" and a "due process violation." He hinted that he may ask the judge to dismiss the indictment or force prosecutors to recuse themselves if the judge rules that the materials were obtained improperly.
The investigation into the alleged crimes remains ongoing, and prosecutors emphasized that the seized materials were vetted by a "Filter Team" before being given to the prosecuting team. The judge asked both sides to submit written arguments in the coming weeks.
