The accuser identified only as H.W., who seeks more than $50,000 in damages, is expected to appear in court on May 8 to detail her alleged relationship with the 'I Believe I Can Fly' singer.

AceShowbiz - One of R. Kelly's sexual abuse accusers has won a default judgment against the R&B star after he ignored her civil lawsuit.

The judge overseeing the case gave the win to the woman, named H.W. in court papers, after her lawyers pointed out that Kelly and his legal representatives had ignored all court summonses.

"Robert Sylvester Kelly has failed and refused to file an appearance or answer to the Complaint even though (he is) required to do so," the plaintiff's lawyers wrote.

The accuser claims she met Kelly at a restaurant, while celebrating her 16th birthday party, and alleges she and Kelly had a year-long sexual relationship in the late 1990s, when she was underage.

"Kelly had sexual intercourse with the minor plaintiff. The defendant also engaged in oral sex with the minor plaintiff. During these repeated incidents, defendant represented to the minor plaintiff that this behavior was appropriate," the lawsuit reads.

Criminal charges were previously filed against Kelly, and H.W. filed the civil lawsuit against him, seeking more than $50,000 (£39,000), while he was behind bars due to unpaid child support payments earlier this year.

H.W. is expected to detail her alleged relationship with the "I Believe I Can Fly" singer at a hearing on May 8, when a judge will determine damages in the civil case.

R. Kelly's publicist tells the Chicago Sun-Times, "We don't care about the lawsuit. The lawsuit means nothing to us."
