Emile Hirsch Is Charged With Assault for Choking Woman, Remains in Rehab

The 'Boy Next Door' actor has been charged with felony aggravated assault for allegedly choking a female Hollywood executive during the Sundance Film Festival last month.

AceShowbiz - Emile Hirsch was charged on Thursday, February 12 with felony aggravated assault for allegedly choking a female Hollywood executive at a party in Utah during the Sundance Film Festival in late January. According to The Associated Press, Emile is facing a misdemeanor count of intoxication. He may face up to five years in prison and a $5,000 fine.

Summit County prosecutor Ryan Stack confirmed to the site that the victim is Daniele Bernfeld, an executive for Insurge Pictures, a Paramount Pictures subsidiary. According to court documents, the altercation happened on January 25 at Tao Nightclub in Park City. Authorities said Emile put Daniele in a chokehold. She later blacked out and two people had to pull Emile off of her.

Emile told police he didn't know Daniele but was having an argument with her. He also admitted to having three to four drinks before the incident.

Emile was not arrested and was ordered to appear before a court in Park City on March 16. His representative, Robert Offer, tells TMZ that the star of "The Boy Next Door" checked himself into rehab after the incident and remains there.

"Regarding the charges that have been brought against Emile today, the facts that I can relay are that he consumed an enormous amount of alcohol on the evening in question and he has no memory of what happened," Robert says, "Emile takes these allegations very seriously, and is devastated that any of this has occurred. A few days after the incident, Emile sought help and checked himself into an alcohol rehabilitation facility, where he remains today, to ensure nothing like this ever happens again."
