Tiffany Haddish wins key ruling in DUI case; judge tosses field sobriety test and statements over officer error.

AceShowbiz - Tiffany Haddish has secured a significant legal victory in her ongoing Georgia DUI case, as a judge ruled that critical evidence cannot be used against her at trial. The ruling, issued Wednesday by a Fayette County judge, excludes the results of a specific field sobriety test and any statements Tiffany Haddish made to police during the initial stages of the stop.
The judge determined that the arresting officer improperly administered the Horizontal Gaze Nystagmus (HGN) test, which requires a suspect to follow an object with their eyes while an officer observes for involuntary movements. According to the court, Haddish informed the officer that she has a lazy eye, yet he failed to ask follow-up questions about the condition and proceeded with the test without making any adjustments. The court concluded that the test was not applied reliably, rendering the results inadmissible.
In addition to throwing out the HGN test, the judge also ruled that Haddish was not read her Miranda rights before the officer began questioning her about the smell of marijuana in her vehicle. The court found that the officer’s statement about needing to "address something" and mentioning the odor of marijuana constituted the beginning of an interrogation, which legally requires the standard rights warning. As a result, any statements she made from that point forward cannot be presented by the prosecution.
However, the victory is not complete. Prosecutors are still permitted to use evidence from two other field sobriety tests that were administered during the arrest. The case, which stems from Haddish's January 2022 arrest in Peachtree City, Georgia, where she was found asleep behind the wheel, has been pending for four years. Her legal team, led by attorneys Marissa Goldberg and Drew Findling, has been aggressive in their defense strategy.
They have recently filed a motion to dismiss the entire case based on speedy-trial violations, arguing that the four-year delay has violated Haddish's constitutional rights and damaged her career. They further contend, according to TMZ, that no one was injured or killed during the incident. This Georgia case is separate from a second DUI arrest in November 2023 in Beverly Hills, where she was also found sleeping in her car on Beverly Drive. The judge’s decision marks a major win for her defense as they continue to fight for a full dismissal of the misdemeanor charges.
