AceShowbiz - Teddi Mellencamp's estranged husband, Edwin Arroyave, has filed his response to her divorce papers. In his response, he claimed they had signed a prenuptial agreement before their 2011 wedding. According to the prenup, "all assets, income from all sources, and obligations of each party are his/her separate property."
Meanwhile, Mellencamp, in her previous petition, expressed uncertainty about the extent of her separate property assets and debts. She requested an amendment to her petition once this information has been ascertained.
Arroyave's response also states that the prenup sets forth specific terms regarding the amount and duration of spousal support to be paid. Mellencamp requested spousal support but checked the box to block Arroyave's ability to receive it from the court.
Meanwhile, Mellencamp has requested primary legal and physical custody of their three children while Arroyave seeks joint legal and physical custody with "reasonable and frequent" visitation. Arroyave listed the date of separation as November 1 while Mellencamp claimed it was October 20.
Both parties have agreed that their reason for splitting was "irreconcilable differences." Mellencamp has stated that she will keep the details of the breakup private for the sake of their children.
The prenuptial agreement will significantly impact the financial aspects of their divorce settlement. Arroyave's response indicates that he expects the prenup to govern the distribution of assets and spousal support, as agreed upon before their marriage.
