AceShowbiz - Eric Holder has suffered another defeat in court as he's facing charges for allegedly killing Nipsey Hussle. The murder suspect had his motion to dismiss two of his six charges related to the shooting denied on Thursday, November 14.

According to The Shade Room, at a Los Angeles courthouse, Judge Robert J. Perry rejected the motion applied by Eric's lawyers to dismiss those two charges in the case. Siding with the prosecution, the judge said, "I'm unwilling to do that."

Eric, who fired multiple shots at Nipsey even after he fell to the ground, also injured two other men outside the Marathon Clothing store in South Los Angeles on March 31. He asked to dismiss the two charges related to the other victims. His lawyers used the Kill Zone Theory to argue that he should not be charged for attempted murder on those two victims. Eric's attorney Lowynn Young suggested that firing a gun at a group of people is "reckless endangerment" at best, but that doesn't mean that a shooter has the intention to kill everyone within that group.

The Kill Zone Theory is used to determine whether a defendant acted with the intent to kill their target. However, the prosecution argues that Eric is in fact guilty of attempted murder on those two other victims. The prosecution notes that although Eric targeted one victim, due to his choice of weapon (two firearms), he had intent to kill everyone in a particular zone, especially given that his initial target was not moving.

Eric currently faces one count of murder, two counts of attempted murder, two counts of assault with a deadly weapon and one count of felony possession of a firearm. He has pleaded not guilty to all six charges. His case will now move forward to trial in February 2020. If convicted, the 29-year-old faces a maximum sentence of life in prison.
