Days after being ordered to pay Nick Loeb almost $80,000 in legal fees, the 'Modern Family' star is handed a victory over his long-running fight to gain custody of their frozen embryos.

AceShowbiz - Sofia Vergara's former fiance has had his long-running fight for custody of their frozen embryos thrown out of court in Louisiana.

The "Modern Family" star has been locked in a nasty court fight with Nick Loeb ever since they split in 2014, after refusing to grant him permission to have two embryos they had frozen while they were together brought to term.

Under the terms of their arrangement, both parties have to give their consent before either of them can take action.

Loeb had his legal efforts shut down twice prior to 2018, before trying his luck with the judicial system in Louisiana, where embryos are considered "biological human beings" under state law.

However, it has since been revealed that Loeb's latest case was dismissed "with prejudice" on 11 October, meaning he cannot refile, according to the New York Post's Page Six.

Vergara was handed the big victory by Judge Kevin D. Conner, who called into question Loeb's claim of residence in Louisiana in order to pursue his court case in the state.

Despite the setback, Loeb's lawyer remains undeterred, telling Page Six, "We will be appealing the court's decision. (The embryos) are human beings with every right to their lives and every right to be born."

The news emerges days after Vergara, who has been married to actor Joe Manganiello since 2015, was ordered to pay her ex almost $80,000 (£62,150) in legal fees after her previous countersuit for malicious prosecution was dismissed in a California court.
