The 'Say Something' singer is seeking to dismiss the lawsuit filed in 2016 by PK Music Performance who claimed that he, will.i.am and Sony Music sampled Perry Kimble's song without permission.

AceShowbiz - Justin Timberlake is asking a judge to dismiss a lawsuit filed against him over 2006 song "Damn Girl".
Bosses at PK Music Performance sued the "Suit and Tie" hitmaker, producer will.i.am and executives at Sony Music in 2016, claiming they sampled Perry Kimble's 1970s song "A New Day Is Here At Last" without their permission. Executives at PK obtained the rights to Kimble's song in 1999, following his death.
Timberlake is now fighting back, arguing his song was "independently created" and therefore he shouldn't be sued.
In documents obtained by The Blast, Justin claims that any similarities between the two tracks are generic.
He also reportedly claims if a sample of the song was used, it was licensed through a man named Josh Davis, who represented himself as the sole owner of the rights.
PK bosses are seeking an injunction prohibiting Timberlake from continuing to profit from of the song and unspecified damages.
