A photographer claims the 'Interview' actor headbutted him during a Lana Del Rey concert which took place in a cemetery.

AceShowbiz - James Franco is being sued for allegedly headbutting a photographer in a cemetery. David Tonnessen claims in his suit that the star of "The Interview" headbutted him during a Lana Del Rey concert at the Hollywood Forever Cemetery in October 2014.

According to the suit filed in Los Angeles Superior Court, David was taking photos at Lana's show when he spotted James "smiling rather demonically." With a "blank expression of joy on his face," the "Spring Breakers" actor then charged the photographer and head-butted him in the stomach, sending him to the ground "in shock and pain."

"Following the assault, battery and intentional infliction of emotional distress, defendant Franco ran laughing into the crowd, leaving Plaintiff wounded and in pain on the ground," according to the complaint.

David claims he was hospitalized with "severe and permanent physical and psychological injuries." He is suing James for assault, battery and intentional infliction of emotional distress and is seeking monetary and punitive damages.

A representative for James hasn't responded to a request for comment.
