Marvel won't allow its writers to create any new characters for the mutant series because those characters will automatically be owned by Fox for movie adaptation.

AceShowbiz - Marvel and Fox dispute continues. According Marvel's comic author Chris Claremont, the company no longer allows its writers to create new characters for "X-Men" graphic novel in an attempt to avoid giving Fox more toy to play with on-screen in the mutant universe.
"I have to say quite honestly as I understand it now the X department is forbidden to create new characters," Claremont opened up at the Phoenix Comic Con as quoted by Bleeding Cool. "All because all new characters become the film property of Fox." He added, "There will be no X-Men merchandising for the foreseeable future because, why promote Fox material?"
It was previously revealed that Marvel would also close "The Fantastic Four" comic series to avoid giving promotion, however small it might be, to Fox which is currently rebooting the story for a 2015 movie. Marvel will end its First Family on June 30, before the new F4 movie arrives in theaters on August 7 next year.
