Diddy Seeks to Dismiss Some Counts in Sexual Assault Lawsuit Because of Unexisting Laws

The embattled hip-hop mogul also claims that Joi Dickerson-Neal, who accuses him of sexually assaulting her in 1991, can't sue his companies Bad Boy Records or Bad Boy Entertainment.

AceShowbiz - Sean "P. Diddy" Combs' legal team is looking through the history of laws to relieve them of some burden in his case. The rapper has filed a motion to dismiss some counts in one of his sexual assault cases because of unexisting laws.

According to new court documents filed by Diddy's legal team and obtained by TMZ on Friday, April 26, his lawyers are seeking to dismiss some of the claims made by Joi Dickerson-Neal. Joi filed a suit against the hip-hop mogul in November 2023, claiming he drugged and sexually assaulted her back in 1991, but Diddy's lawyers point out that some of the laws did not exist at the time of the alleged incident.

Joi filed six causes of action against Diddy, one of which made under the New York Services for Victims of Human Trafficking Law. However, his lawyers note that the law wasn't in effect until 2007, about 16 years after the incident took place.

Diddy's legal team is also contesting her claims under the New York State Revenge Porn Law, codified in 2019, the New York City Victims of Gender-Motivated Violence Protection Law, which was passed in 2000, and the 2016 NYC Revenge Porn Law.

Diddy's lawyers are calling for claims made under these laws to be dismissed with prejudice while also maintaining that their client didn't commit to the alleged acts at all. They, however, are not making the same argument for two other counts, common law claims for assault and battery and intentional infliction of emotional distress that don't rely on specific statutes, because the arguments about the timing of certain statutues being passed don't apply to those claims.

Diddy's lawyers also say that Joi can't sue his companies Bad Boy Records or Bad Boy Entertainment bcauses both companies didn't even exist yet at the time of the alleged incident.

Joi is one of women who have sued Diddy for alleged sexual assault. His ex-girlfriend Ciara first sued him in November 2023, accusing him of rape, sex trafficking and physical abuse during their relationship that lasted from 1991 until 2003. After settling the suit with his ex, Diddy was sued by three other women, including Joi, for similar claims.

In February 2024, music producer Rodney "Lil Rod" Jones filed a lawsuit against the 54-year-old star, claiming that Diddy drugged and sexually assaulted him and also forced him to have sex with sex workers.

Diddy has denied all allegations made against him. In late March, his mansions in Miami and Los Angeles were raided by the Department of Homeland Security as part of a sexual trafficking investigation.
