AceShowbiz - One of the sexual assault lawsuits filed against Trey Songz has been thrown out. According to a new report, a judge has granted the embattling musician's motion to dismiss a lawsuit accusing him of exposing a woman's breast.
When Trey's team asked for the case's dismissal, they noted that the statute of limitation for the alleged incident had passed. The judge agreed that the plaintiff had missed California's ten-year window to file.
The woman, who used the Jane Doe pseudonym to protect her privacy, filed the lawsuit on June 1. In the legal docs, she claimed that Trey grabbed and exposed her breast at a 2013 pool party after she merely tried to get a picture with him.
Jane Doe said the alleged assault happened in August at the Foxwoods Resort in Connecticut. In a video of the incident, the woman was excitedly filming herself and the 38-year-old singer, who was standing next to her.
Trey was then seen grabbing the woman's bathing suit top, pulling it and exposing her breast. "In what appeared to be an attempt to further terrify and humiliate [the woman], [Trey Songz] followed the assault with a degrading chant, 'Titty in The Open … Titty in The Open,' " the lawsuit stated.
Aside from Trey, the woman listed his production company, record exec Kevin Liles and Atlantic Records as defendants because they were "negligent in their supervision of their client". She was demanding $10 million for sexual battery and assault.
"Entities such as Atlantic Records and key executives like Kevin Liles must reassess their obligations toward ensuring the safety and dignity of everyone at any event associated with their artists," the accuser's attorney George Vrabeck told Rolling Stone. "My client demands transparency, accountability, and a prioritization of safety over profits."
