AceShowbiz - Olivia Wilde has scored a win in a legal battle against her former fiance, Jason Sudeikis for the custody of their children. On Wednesday, a judge dismissed the "Ted Lasso" star's petition for their two kids to live in New York.

According to court documents, obtained by Daily Mail, "Judge Powell and this Referee agreed that New York was not the home state of the subject children; but rather California was the children's home state."

It further read, "Therefore, for the reasons stated on the record on July 15, 2022, respondent's motion to dismiss the custody petitions filed on October 21, 2021 is granted as this court finds that New York does not have jurisdiction to hear the custody petitions as New York is not the home state of the subject children."

Olivia, who shares 8-year-old son Otis and 5-year-old daughter Daisy with Jason, was infamously served with the legal papers at the CinemaCon in Las Vegas. At that time, she was promoting her movie "Don't Worry Darling".

"This is for me? Is this a script?" the mom of two asked in a video that surfaced online. She took a peek inside the envelope, which was labeled "personal and confidential," before she said, "Ok got it. Thank you." She then continued the presentation like nothing happened.

However, in her court filing, Olivia accused Jason of trying to embarrass her. "Jason's actions were clearly intended to threaten me and catch me off guard. He could have served me discreetly, but instead he chose to serve me in the most aggressive manner possible," she stated.

"The fact that Jason would embarrass me professionally and put our personal conflict on public display in this manner is extremely contrary to our children's best interests," she continued. ""Since Jason has made it clear that we will not be able to work this out for our children's sake outside of the court system, I filed a petition for custody in Los Angeles."

The exes previously had an amicable co-parenting agreement. However, things took a turn since Olivia reportedly plans to relocate to London, where her boyfriend Harry Styles lives.
