An attorney for the 'Fefe' rapper has been fighting to have his client freed from the Queens Detention Facility because he is at a greater risk of death if he contracts COVID-19 while behind bars.

AceShowbiz - Incarcerated rapper Tekashi 6ix9ine is on track to potentially be released on Wednesday evening, April 01, if New York prosecutors do not object to the judge's recommendation over coronavirus concerns.

The "FEFE" star's attorney, Lance Lazzaro, has been fighting to have his client freed from the Queens Detention Facility and allowed to serve out the remainder of his prison sentence under home confinement because as an asthma sufferer, he is at a greater risk of death if he contracts COVID-19 while behind bars.

Last week, ends March 27, the judge overseeing his case admitted he would have recommended house arrest at the time of sentencing in December (19) had he known there would be a global pandemic, but insisted he didn't have the authority to release Tekashi, real name Daniel Hernandez.

Instead, Judge Paul Engelmayer urged Lazzaro to file his appeal for compassionate release with officials at the Bureau of Prisons.

He did just that, but they rejected the motion because the facility is a privately-run property, and is therefore not under the Bureau's control.

Lazzaro turned to Judge Engelmayer once more on Tuesday, explaining his predicament: "In this case, your Honor now has the statutory authority to modify Mr. Hernandez's sentence so as to immediately release him from prison," the attorney wrote.

On Wednesday morning, the judge filed a letter with federal prosecutors, outlining his intention to grant Tekashi's home confinement request, unless he receives any pushback by 5pm EST, reports the New York Post.

Tekashi is currently serving a 24-month sentence for gang-related activity with the Nine Trey Gangsta Bloods. He had been expected to be released from prison this summer.
