Attorneys for 'The Cosby Show' star, who is serving three to ten years in prison for sexual assault, reportedly assert that Judge Steven O'Neill's ruling was more punitive than necessary.

AceShowbiz - Bill Cosby's lawyers are seeking to overturn his sexual assault conviction and sentence.

The 81-year-old "The Cosby Show" star was put behind bars last month after he was sentenced to serve three to ten years in state prison for drugging and assaulting Andrea Constand at his Pennsylvania home in 2004.

The disgraced comedian's attorneys argue Judge Steven O'Neill erred in declaring Cosby a sexually violent predator and that is sentence was more punitive than necessary, according to CBS Philly. They also cite his health problems and age as being reasons why his conviction should be overturned and argue prosecutors never proved the assault didn't take place outside of the 12-year statute of limitations.

Cosby is currently serving his sentence at State Correctional Institution - Phoenix in Schwenksville, Pennsylvania.
