Darryl Payne claims Barry and his people didn't obtain the licensing rights to include Judy footage in a promotional video of his 2014 album 'Duets'.

AceShowbiz - Barry Manilow has been sued for allegedly using footage of Judy Garland to promote a 2014 "Duets" album without permission.

Darryl Payne, who insists he's the rightful owner of the clip of Judy singing "Zing! Went the Strings of My Heart", claims Barry and his people didn't obtain the licensing rights to include it in the promotional video.

In court papers obtained by TMZ, he also accuses Manilow of using the Garland clip at his live shows on at least 68 occasions without permission.

Payne is demanding Manilow pulls his Garland duet and hand over profits he's made from it.
