Disney and Deadmau5 in Dispute Over Mouse Ears Logo
Celebrity

The Walt Disney Co. claims that the DJ's logo 'is nearly identical in appearance, connotation and overall commercial impression' to their own.

Disney and DJ Deadmau5 are now in legal battle over his mouse ears logo. The Walt Disney Co. filed documents to the U.S. Patent and Trademark Office on Tuesday, September 2 to block the performer's attempt to gain trademark over his logo.

As reported by Variety, in the documents, Disney claims that Deadmau5's logo is "is nearly identical in appearance, connotation and overall commercial impression to Disney's Mouse Ears Marks." According to the company, the similarities will cause confusion as "both parties marks are comprised of a round head with prominent round mouse ears in silhouette." Disney also argues that their mouse has been used starting from 1928.

Disney's objection was filed after Deadmau5's camp filed the trademark for "mau5head" in June 2013. "Given that the mau5head, and other identifying deadmau5 trademarks, have been used in the U.S. and around the world for almost a decade, we wonder why Disney is only now coming after deadmau5," the DJ's lawyer Dina LaPolt told Radar Online. Deadmau5's lawyer also said that the DJ "will not be bullied ... and is prepared to fight to protect his rights to his property."

Deadmau5, whose real name is Joel Zimmerman, also has commented on the legal drama. "Disney thinks you might confuse an established electronic musician / performer with a cartoon mouse. That's how stupid they think you are," he tweeted on Tuesday.
