The 'Liz and Dick' lead female will not be prosecuted because there is not enough evidence that proves she attacked Tiffany Mitchell at the club Avenue last year.

Things seem to continue look good for Lindsay Lohan who had a rough year in 2012. After avoiding jail in reckless-driving and lying-to-cop charges, she is now off the hook in the assault case stemming from an alleged fight with another female in a New York bar last year.
LiLo was arrested on misdemeanor assault charges after an alleged catfight with Tiffany Mitchell at the club Avenue in the city's trendy Meatpacking District. Prosecutors passed the case because there was no sufficient evidence that could prove the actress struck Mitchell.
Manhattan District Attorney Cyrus Vance remained mum, but rumor suggested witnesses who were on the scene that night refused to cooperate with police. Members of The Wanted reportedly were there when news about the fight first broke out last fall.
Additionally, surveillance video did not show the "Liz & Dick" actress attack Mitchell who was caught on camera tripping and falling when being escorted out of the club.
"This was the final legal hurdle to overcome and clear the path for Lindsay's freedom," LiLo's lawyer Mark Heller said. "She's totally clear and exonerated. She has nothing but smooth sailing ahead."
Gloria Allred who represents Mitchell has also reacted to how the case turned out. "Tiffany is very disappointed that the District Attorney has not decided to prosecute Lindsay," the powerhouse attorney tells E! News, adding she had "two witnesses who spoke to the D.A. and corroborated what Tiffany alleged to have occurred."
"The District Attorney has never told us that there was any issue about Tiffany's credibility," the lawyer continues. "Nor did the District Attorney indicate that their office believed that what Tiffany reported was unfounded. Ms. Mitchell is considering all of her legal options in the civil justice system because of what she suffered that night."
"Tiffany has also been unfairly and inaccurately portrayed in the press," Allred concludes. "She looks forward to responding in the future and to making sure that the full and accurate story of what happened that night is told."
In the meantime, LiLo still has ninety days in a locked rehabilitation facility looming over her head after pleading no contest to the charges stemming from a car crash in the summer of 2012. The plea deal also includes 30 days of community labor, 18 months of psychological counseling, a fine and restitution.
