'The reason Simon hasn't said anything is because he has been working to try and make sure she is on the show,' the former 'American Idol' judge's publicist says on Cheryl's uncertain status.

AceShowbiz - There is still a possibility that Cheryl Cole will judge "The X Factor (US)". Although there have been reports that she has been replaced by Nicole Scherzinger due to her thick accent, Simon Cowell is still fighting to have the Girls Aloud singer staying on the show.

"Simon's position is clear - he wants her to be on the show if that's possible," Max Clifford, a publicist for the British music mogul, said. "The reason Simon hasn't said anything is because he has been working to try and make sure she is on the show."

Max noted that Simon's wishes cannot easily come true because "obviously there's other important people involved in this decision in America and they've all got to be happy." He added, "Hopefully the situation will be clarified as soon as possible, because it's been as clear as mud for the last week - but talking to him a couple of hours ago, I think that's a pretty fair summary of where we are."

Max made it even clearer that Simon does not have the final say, and thus "in two or three hours time it could change and they could announce she's not going to be on it." In the meantime, Cheryl's camp has not commented on the latest report.

The representative for Simon also denied that Cheryl's uncertain status on the judging panel is just a publicity stunt. "It's not a good publicity stunt and you don't need it," he claimed. "When you've got such a hot show and so much at stake you really don't need [this publicity] because if it looks as if there's a weak link or problems, it doesn't excite and have the desired effect."
