AceShowbiz - T.I. and his wife Tiny Harris (Tameka Cottle) are trying to have their sexual assault lawsuit thrown out by a judge. The married couple reportedly filed a motion to dismiss the case on Thursday, July 4.
"All the claims asserted in the Complaint are time-barred because the statute of limitations for such claims has long expired over sixteen years ago," their attorneys argued. "Further, notwithstanding the fact that Defendants Clifford Harris ('Mr. Harris') and Tameka Harris ('Mrs. Harris'') (collectively 'Defendants' or 'Harrises'), deny that any of the alleged conduct even occurred, the Complaint fails to allege facts to sufficiently establish any of the claims alleged in the Complaint.
"Accordingly, Defendants seek to dismiss all the claims in the Complaint … for failure to state a claim upon which any relief can be granted," they added. "Because there is no possible remedy for these deficiencies … Defendants seek dismissal of this entire action."
T.I. and Tiny want the case to be dismissed "in its entirety, with prejudice". It means that if the motion is successful, Jane Doe won't be able to refile the complaint.
Jane Doe filed her complaint against T.I. and Tiny in Los Angeles on January 2, 2024. She claimed she "did not consent to any of the sexual assault or misconduct" that occurred nearly two decades ago.
The woman said he was in her early 20s and serving in the U.S. Air Force when she met the couple around 2005 while stationed in Los Angeles. She was allegedly introduced to the pair in the VIP section of a club by a man named Caviar, with whom she'd attended a party at the home of late rapper Coolio the night before.
While at the club, Jane Doe claimed Tiny gave her a drink, and then brought her back to a hotel room with T.I. and two other women. After the two other women left, the plaintiff alleged that the 48-year-old singer/songwriter took her clothing, and she was left feeling "extremely shocked and uncomfortable" after the couple joined her in the shower.
After the shower, during which T.I. allegedly told Jane Doe that Tiny would bathe them both, Doe claims she was "signaled" to get into bed with T.I. She said she felt "extremely dizzy and lightheaded" as she made her way there, leading her to believe she'd been drugged.
While on the bed, T.I. allegedly turned on a pornographic movie and demanded Doe rub oil on his back and naked body. Then, Tiny joined them in bed and allegedly began to massage Doe, making her feel "sick, disgusted and nauseated," according to the lawsuit.
