The 'Keeping Up with the Kardashians' member is dragging a doctor to court for using her name and likeness to promote his cosmetic procedure after he ignored her cease and desist letter.

AceShowbiz - Kim Kardashian is suing a doctor she alleges is using her name and likeness to promote his "vampire facial" cosmetic procedure.

The 39-year-old star famously had the treatment, which involves injecting your own blood back into your face, in 2013 while filming her reality series "Kourtney and Kim Take Miami", but later said she regretted it as pregnancy meant she was unable to take painkillers after the procedure.

She is now suing Alabama doctor Charles Runels for allegedly using her name and likeness without her permission to promote his version of the facial.

In her complaint, the reality star claims Runels had put the Kardashian name on the front of a brochure for the treatment, as well as on his website, and had also used an Instagram snap in promotional materials.

The procedure has caused controversy after two patients at a clinic in New Mexico contracted the HIV virus after undergoing a vampire facial, and Kim alleges Runels used her and model Bar Refaeli's images to reassure potential patients.

"Just below a post disclaiming any association with the Vampire Facial provider from which patients had contracted HIV is a photo captioned, 'Bar & Kim Receive the Vampire Facial Procedure,' " her attorney Michael Kump writes in the complaint.

The complaint continues, "Runels' scheme to misappropriate Ms. Kardashian's hard-earned popularity without her permission is so pervasive that she features prominently in, of all places, his LinkedIn profile. Quite literally, on his profile page, her photo is twice as large as his."

Kump states that Kim contacted Runels and asked him to cease and desist, but the doctor refused and also demanded that she pay him.

Kim's claims against the doctor include copyright and trademark infringement, false association and violation of the right of publicity and she is seeking unspecified statutory and punitive damages, disgorgement of any profits gained and an injunction banning the use of her image or name.
