Law enforcement sources tell TMZ no one in the 1970 Plymouth Barracuda was strapped in when driver Jared Black drove it off a canyon road near Calabasas, California at the beginning of September.

Following an investigation, California Highway Patrol officials have declared the Barracuda crashed after Black lost control.

They insist there's no evidence of mechanical issues.

But Hart doesn't appear to be blaming the driver of his wrecked car, which he bought himself as a birthday gift earlier this year, telling TMZ through his lawyer, Andrew Brettler, "I have nothing but love for Jared and wish him and (fellow passenger) Rebecca (Broxterman) a speedy recovery".

Kevin suffered three spinal fractures in the accident and underwent serious back surgery, with doctors fusing three sections of his spine.

Jared suffered similar injuries to Kevin.
