'He has expressed very clearly that he does not want to return to New York,' says Guy's lawyer Eric Buckley of 15-year-old Rocco.

AceShowbiz - Madonna and her ex-husband Guy Ritchie's son, Rocco, doesn't want to spend holiday with his mom in the U.S. After her son refused her request, the "Living for Love" singer brought the case to a court and a judge ordered on Wednesday, December 23 that the 15-year-old boy, who's currently staying with his dad in London, had to return to New York against his wishes, New York Daily News reported.

Guy's lawyer Eric Buckley said of Rocco, "He has expressed very clearly that he does not want to return to New York." Manhattan Supreme Court Justice Deborah Kaplan asked, "Has he prevented the child from returning to the U.S.?" to which Eric replied, "Effectively yes."

The judge then said the boy should talk with Madonna and then revisit the issue regarding which parent he prefers living with. "I'm granting you all the relief you have requested," Deborah told Madonna. "I'm directing the child to be returned to New York. If he wants to stay with his father, he must return to his mother."

A source close to the case told Page Six that Rocco might not obey the judge's order, "This is a 15-and-a-half-year-old strapping young kid, so we'll see." The source explained that Rocco had been traveling with Madonna for her "Rebel Heart" tour for the last two months. "The boy said he didn't want to stay with her," said the source. "He's not getting along with his mom, which is not a surprise for a child that age."
