Kesha Wins First Round in Dr. Luke Case

A judge has ruled that the 'TiK ToK' hitmaker's claim of being raped will be put ahead of Dr. Luke's defamation claim.

AceShowbiz - Kesha, formerly known as Ke$ha, has won the first round in her case against Dr. Luke. According to The Hollywood Reporter, New York Supreme Court justice Shirley Werner Kornreich decided earlier this month that Kesha's California lawsuit should move ahead of Dr. Luke's New York lawsuit.

Shirley said both Kesha and Dr. Luke's lawsuits presented "similar claims with the possibility of inconsistent judgments, and the California case alleges specific California statutory claims." The judge also pointed out that Kesha and Dr. Luke both live in California and the alleged sexual assault also took place there.

The site reported that Dr. Luke's attorneys were mad at the decision and filed a notice of appeal on Friday, March 20, asking Shirley to delay Kesha's lawsuit in favor of their own. Dr. Luke's attorneys argued that Shirley "lacked discretion to effectively re-write the parties' contracts," to pause a dispute that involves parties who aren't involved in the California lawsuit and to hold off on adjudicating his claims of defamation and breach of contract.

Kesha filed her lawsuit back in October, accusing Dr. Luke of giving her a date rape drug and physically abused her among others during their decade-long partnership. Dr. Luke later filed a countersuit, claiming the "TiK ToK" hitmaker and her mother were lying and claimed that "extortion [was] the ultimate goal of this defamatory campaign."
