Tracy Morgan Sues Wal-Mart Over Car Crash

The former '30 Rock' actor, who suffered from numerous broken bones following the crash on New Jersey Turnpike, claims in the suit that 'Wal-Mart was careless and negligent.'

AceShowbiz - Tracy Morgan has filed a lawsuit against Wal-Mart, the company which owns a truck which allegedly hit his limo in a June crash on New Jersey Turnpike. The actor/comedian, who suffered from numerous broken bones due to the crash, filed the suit in U.S. District Court in New Jersey on Thursday, July 10.

"Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries," the document read. It also alleged that Wal-Mart "knew or should have known" that the truck driver Kevin Roper had been awake "for more than 24 consecutive hours" prior to the crash.

The suit also claimed that the company "had a custom and practice of recklessly and intentionally allowing its drivers to drive for prolonged and unreasonable periods of time." It mentioned Roper who had to commute 700 miles from his Georgia home to the distribution center in Delaware while there are other distribution facilities which are nearer to his home. It claimed that Roper was fatigue and fell asleep before the accident took place.

The former "30 Rock" star and other plaintiffs which included James McNair's widow Krista Millea, Morgan's assistant Jeffrey Millea and comedian Ardie Fuqua are suing for negligence, while Krista Millea is also suing for loss of consortium. They are seeking a jury trial, compensatory and punitive damages and attorney's fees.

"This has been a terrible tragedy. We wish Mr. Morgan, Mr. Fuqua Jr., and Mr. Millea full recoveries," Wal-Mart said in a statement, as quoted by The Hollywood Reporter. "We are deeply sorry that one of our trucks was involved. As we've said, we're cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we're committed to doing the right thing for all involved."
