In order to avoid charges, the 78-year-old 'Modern Family' actor has to obey the laws relating to his alleged offense in the alternative program.

AceShowbiz - Fred Willard is offered an Alternative Prosecution Program in lewd conduct case after his arrest in an adult theater on Wednesday, July 18 evening. The 78-year-old actor won't be charged if he's willing to enter and complete the diversion course.

The Frank Dunphy of "Modern Family" reportedly has to pay $380 for the course. During his participation in the program that may last for two weeks, the Emmy-nominated star is required to obey the laws relating to his alleged offense.

Fred was taken into custody on suspicion of lewd act during a routine inspection at the Tiki Theater by Los Angeles Police. He strongly denied the offense, claiming he and the police just had "a difference of opinion" as to what happened.

Although he hasn't been charged or convicted, PBS fired him from its show "Market Warriors". Representative Jeanne Hopkins explained, "It's something we felt was important to decide, and given the trust of our audiences, we wanted to move forward."
