A court hearing determined that there is no evidence that Gabriel Aubry put daughter Nahla in danger like his former nanny has testified.

AceShowbiz - Gabriel Aubry is off the hook after a judge closed a pending child-endangerment case put up against him. Halle Berry's ex and baby daddy appeared in the dependency court on Thursday, March 8 for the hearing of a case brought up upon suggestion from the Los Angeles County Department of Family and Children Services.

A former nanny reported Aubry to the DFCS, accusing the model of yelling and shoving her while she was holding his daughter Nahla. DCFS went in to investigate, including interviewing Berry whose words are sealed in court documents. However, the org could not find any evidence of Nahla in any danger, suggesting at the court that Aubry's visit for Nahla to be no longer supervised.

According to E! News' source, Aubry was sent back to the family court to fight the custody of Nahla after the child-endangerment case was dropped and no charges were filed. Judge also denied the request from the nanny to get an order of protection against Aubry.

Although one case is solved, Aubry reportedly is sick of these accusations against him. "If he gets dragged in again over baseless claims, that are found to be unsubstantiated and lacking evidence, he will sue [Halle]," a source told RadarOnline. "Gabe has had enough and is extremely frustrated with Halle. All of the proceedings in their custody case are sealed but if he were to file a lawsuit against her it would be made public. Gabe has had to jump through hoops because of Halle's accusations when he takes care of Nahla, and NONE of it has been found to have any merit."
