Halle Berry Fails to Immediately Keep Gabriel Aubry Away From Daughter

Though she was quick to ask for an emergency hearing when her ex was accused of child endangerment, the 'Frankie and Alice' star will have to wait until January 30 to get a judge's decision.

AceShowbiz - When Gabriel Aubry faced accusations of child endangerment and misdemeanor battery, Halle Berry was quick to ask for an emergency hearing to keep him away from their daughter Nahla during investigation. It turned out, however, that the "New Year's Eve" actress didn't manage to get an immediate stay-away order against her ex-boyfriend.

Berry and Aubry showed up before a judge in Los Angeles Superior Court on Tuesday, January 24, morning for a closed-door hearing. The 45-year-old actress came to the court wearing jeans, leather jacket and brown scarf, while her 36-year-old ex opted to don a slim-fitting gray suit. He was accompanied by lawyers Gary Fishbein and Kristina Royce.

The hearing came to an end after roughly 40 minutes, and Fishbein told New York Daily News that "nothing happened". TMZ additionally detailed that Judge Scott Gordon delayed from making any decision until next Monday, January 30 when Judge Mark Juhas, who's been overseeing the case, returns from vacation.

Aubry found himself being investigated for child endangerment and misdemeanor battery after Nahla's nanny Alliance Kamdem filed a police report against him. In court paperwork, Kamdem claimed that the male model pushed her out the door while she was holding his toddler daughter in her arms after she questioned him about Nahla's absence from school.

Kamdem, who has since the incident quit her job, also filed for a restraining order against Aubry. She claimed that she was "psychologically traumatized" on the job, and that Aubry has been "verbally abusive and aggressive" toward her. A Los Angeles County judge, however, rejected her request, calling her petition "insufficient and speculative."
