However, founder of Vivid Entertainment said they 'feel comfortable' with the position in the legal procedure and he encourages McCready to talk to him personally.

AceShowbiz - Following the news that a sex tape of Mindy McCready will be released by Vivid Entertainment, an attorney for the country singer released a statement that says a legal procedure will be applied. McCready and her legal team will prevent an unauthorized release of the tape titled "Mindy McCready Baseball Mistress".

The footage, according to Vivid, is "almost an hour of action interspersed with a narrative about her former lovers, who included Red Sox and Yankees' pitching great Roger Clemens, actor Dean Cain, country singer Alan Jackson and others." A so-called "teaser" has even hit the web and shows a bit of McCready engaging in a sexual activity with a male and revealing intimate details about her affair with Clemens.

In his statement to Fox News, attorney Adam Dread said, "We are not aware of the production or release of the alleged film that seems to have surfaced via various media reports. However, we can confirm that any illegally- obtained property, and/or fabricated footage, and the release thereof, will be dealt with swiftly following proper legal procedure."

In response to this possible lawsuit, founder/co-chairman of Vivid Entertainment, Steven Hirsch said he is all prepared. "We acquired the McCready video awhile ago and feel comfortable with our legal position to distribute it. You really have to see it to believe it," Hirsch told Pop Tarts. "If Mindy wants to discuss the video, she should feel free to contact me."
