The former star of TV's "The O.C." was pulled over around 2:45 A.M. on December 27, when she was driving on La Cienega Boulevard in West Hollywood, California. The authorities stopped her after they saw her vehicle straddling two lanes of traffic and failing to signal for a turn. Was briefly jailed before then being released on 10,000 dollars bail, Mischa was charged with four misdemeanor criminal counts; driving under the influence, driving with a blood alcohol level of .08|percent| or higher, driving without a license, and possession of marijuana (under an ounce).

Having her attorney, Anthony V. Salerno, entered the plea on her behalf, Barton had a charge of marijuana possession being dismissed, and another for driving with an invalid license reduced to a traffic violation. The plea deal saw Superior Court Judge H. Chester Horn Jr. sentenced Barton to three years of unsupervised probation, three-month alcohol-education class and ordered her to pay a $1,652 fine and additional fees of $312. She must complete her alcohol-education program by September 17 later this year.

In a statement released after the hearing, her lawyer Anthony V. Salerno added, "Ms. Barton understands the seriousness of this situation and assumes full responsibility for her actions. She and I are grateful to the Court and the District Attorney's Office for the prompt and respectful resolution of the case."
